California

Hundreds of thousands of workers can now choose for themselves whether to pay union dues or not.

In July of 2014, the U.S. Supreme Court struck down an Illinois "scheme" by which individual home health care providers had union dues automatically withheld from their state Medicaid reimbursement payments.

The Court reasoned in Harris v. Quinn that compulsory payments to the union violated providers' First Amendment rights to freedom of speech and association. As a result of the decision, providers in California who resign (or never sign up for) union membership no longer have to pay any dues to the union.

Many providers may not even be aware that the union currently has an arrangement with the government to take a portion of their IHSS payments.

The Harris decision means that In-Home Support Services (IHSS) home care providers can now make their own decision about whether to pay a union.

Select the county in which you are registered as a care provider to learn how to reclaim the money being withheld.
